Are checks finally going away?

Not in my lifetime!  While the volume of paper checks written may decrease over time, market dynamics do not support this for the forseeable future.  Checks will go away when future generations no longer write checks, but only use electronic means for paying bills, buying groceries, or sending money to Uncle Bob.  In the interium, how checks are processed is clearly changing.  While latest estimates of total check volume approximates 30 billion per year, inroads in ACH conversion and image exchange have reduced the number of paper checks presented for payment to the 2 billion neighborhood.  While this reflects great success in the paper to electronic transision, it is still a huge number.  Try writing your name even 100 times and you'll realize how many 2 billion paper checks can be.

Q: Can a paying bank refuse to accept a check presented for payment via image?
A:  Yes, all image exchanges are governed by bilateral/multilateral agreements.  Any paying bank may refuse to accept an image check if they don't want to do business with the collecting bank.    back

Q: Does check 21 legislation enable any bank to present image items to another bank?
A:  No, thought widely misunderstood, check 21 legislation merely permits the reprinting of a check/substitute check from an appropriate image of the item.  While Check 21 has nothing to do with image exchange, it has none the less been a catalyst for the conversion of paper to electronic/image processing.    back

Q:  Can a paying bank refuse to accept a check presented for payment from a specific collecting bank?
A:  No, while Reg CC regulations permit the paying bank to designate where checks may be presented for payment, they can not refuse any checks presented at these locations.     back

Q:  What is the difference between a local versus non-local check?
A:  Prior to March 2010 there were multiple check processing regions in the US - roughly 1 region in each of the 12 Federal Reserve districts.  With the Fed's consolidation of all paper check processing into Cleveland, there in effect is now only one FRB check processing region and thus all checks  are local.  For example, a check draw on Bank of  America, San Francisco and deposited into a consumer account at JP Morgan Chase New York, is a local item and next day availability must be provided as such.    back
